Toxic Tort Litigation

The defense of toxic tort and mass tort claims, including asbestos related cases, environmental contamination and chemical exposure, is a significant part of the practice at C&Y. Our clients include manufacturers of chemical solvents, companies that have used various chemicals and minerals, including asbestos in the manufacture of their products and insurance companies in coverage disputes. The cases involve claims brought under both state and federal environmental statutes, as well as in tort.

Our significant experience in various scientific and medical fields enables us to efficiently manage the science, medicine and technology, as well as the complicated legal issues associated with toxic tort litigation. We thoroughly investigate each case and actively seek favorable outcomes for our clients throughout the discovery and pre-trial phases. Our attorneys also understand the need to coordinate with the client and to structure a litigation-wide and trial-specific strategy that seeks a positive resolution of the case at hand, but also which protects our clients across an existing or potential body of litigation.

Our partners have extensive experience in jury and non-jury trials in both federal and state courts throughout the United States, having tried or participated in the trial of cases from Yakima, Washington to Enterprise, Alabama, and from Denver, Colorado to Media, Pennsylvania. For more than 30 years, for example, our partners have represented defendants in asbestos-related personal injury and property damage claims and trials. Through this work, we have had experience in locating, preparing and presenting expert witnesses in many different medical and technical fields. Our partners have also worked in the defense of corporate clients as part of a national defense team, and in representation of those clients in large national class actions. We thus have significant experience working with corporate litigation counsel to devise and carry out discovery and trial strategies.
